This notice of meeting is to inform the public that the Town Council of the Town of Weaverville will hold a Special called meeting on Tuesday, May 21, 2019 at 6:00p.m. in the Council Chambers at Town Hall located at 30 South Main St. The purpose of this meeting is for Town Council to discuss the budget for FY 2019-2020 and expansion of the Water Treatment Plant.  Action may be taken.

The Town of Weaverville has received an offer concerning the sale of property owned by the Town of Weaverville in Buncombe County, North Carolina, and more particularly described as follows:

 

Street Address: 13 Central Avenue, Weaverville, NC, 28787

Parcel Identification Number: 9742-27-8468

Deed Reference:  Book 1054 at Page 316

Conditions:  To be sold “as is”

 

The offer that has been received is for $350,000. Persons wishing to upset this offer must use the approved “Agreement for Purchase and Sale of Real Property” which contains all of the terms and conditions acceptable to the Town for the sale of the property including, but not limited to, an “as-is” condition, required deed restrictions, no loan or other contingencies, and closing within 30 days of acceptance by the Town.

A qualifying higher bid is one that raises the existing offer to an amount not less than $367,550. A qualifying higher bid must be accompanied by a bid deposit in the amount of 5% of the bid and must be submitted in cash, cashier’s check or certified check payable to the Town of Weaverville.  To be considered, a bid must be submitted in a sealed envelope marked “Offer on 13 Central Avenue” and delivered so that it is received by the Weaverville Town Clerk at 30 South Main Street, Weaverville, NC, 28787, by 4 pm on April 22, 2019. At that time the Town Clerk will open any and all offers received and the highest qualifying bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

The Town will return the deposit on any bid not accepted, and the deposit on an offer if a qualifying higher bid is received. The Town will return the deposit of the final high bidder at closing.

The Weaverville Town Council must approve the final high offer. The Town reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject, at any time, all bids.

The offer that has been received is for $345,000. The offer includes a loan contingency and a 60-day due diligence period with closing to occur within 75 days from acceptance of the offer. Persons wishing to upset this offer must submit their offer in a sealed envelope marked “upset bid” to the Weaverville Town Clerk at 30 South Main Street, Weaverville, NC, 28787, by 5 pm on February 4, 2019. At that time the Town Clerk will open the bids, if any, and the highest qualifying bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

A qualifying higher bid is one that raises the existing offer to an amount not less than $362,200. A qualifying higher bid must be accompanied by a bid deposit in the amount of 5% of the bid and must be submitted in cash, cashier’s check or certified check payable to the Town of Weaverville. The Town will return the deposit on any bid not accepted, and the deposit on an offer subject to upset if a qualifying higher bid is received. The Town will return the deposit of the final high bidder at closing.

The Weaverville Town Council must approve the final high offer before the sale is closed. The Town reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject, at any time, all bids.

PUBLIC NOTICE OF TOWN OF WEAVERVILLE’S INTENT TO APPLY FOR FEDERAL ASSISTANCE AND PUBLIC INPUT MEETING

This is a public notice to advise the residents of the Town of Weaverville that the Weaverville Town Council will be submitting an application to USDA, Rural Development, for financial assistance.  The purpose of the assistance will be to construct a new 12-inch DIP water line on Clarks Chapel Road and Ollie Weaver Road to improve the water distribution system reliability and operation. The Town of Weaverville is expecting the USDA loan funding to cover 100% of the estimated $2,970,600 project cost.  The project time frame is estimated as follows: funding requirements complete by 1/1/2019, bid requirements complete by 8/1/2019, and construction complete by 10/10/2020.

A public meeting will be held at Weaverville Town Hall located at 30 South Main Street Weaverville, NC, 28787, on September 17, 2018 at 6:45 p.m. to seek comments.
